Analisis Putusan Hakim tentang Percampuran Harta Bawaan dan Harta Bersama Perspektif John Bordley Rawls

Abstract
Penelitian ini bertujuan untuk menjelaskan tentang dua putusan hakim terhadap perkara pembagian harta bawaan yang telah bercampur dengan harta bersama yang kemudian dianalisis menggunakan teori keadilan milik John Bordley Rawls. Penelitian ini merupakan penelitian hukum normatif (legal research) dengan pendekatan kasus (case approach). Penelitian ini menunjukkan bahwa hakim telah memenuhi nilai keadilan dengan berbagai kriteria adil menurut John Bordley Rawls, walaupun dalam putusannya sekilas menunjukkan ketidakadilan dan berbeda dari Kompilasi Hukum Islam yang menjadi rujukan dalam pembagian harta bersama dalam perkawinan.
